KwaYa Australia Inc. – Terms and Conditions

Welcome to KwaYa Australia Inc. (“KwaYa”, “we”, “us”, or “our”).
By accessing or using our website www.kwaya.org or participating in any KwaYa programs, tours, or events, you agree to the following terms and conditions. Please read them carefully.

1. About KwaYa

KwaYa Australia Inc. is a registered Australian charity (ABN 44 159 377 862).
Our mission is to connect cultures and change lives through music, travel, and community partnerships in Australia, Uganda, and Kenya.

2. Use of this website

You may use our website for lawful purposes only. You must not use the site in any way that:

  • Violates any Australian or international law

  • Impersonates KwaYa or misrepresents your affiliation with us

  • Interferes with the site’s security, functionality, or availability

All content on this site — including text, images, logos, and videos — is owned or licensed by KwaYa and protected by copyright law. You may not copy, reproduce, or distribute this content without written permission.

3. Donations and payments

KwaYa accepts one-off and recurring donations through secure third-party processors (such as Stripe, Humanitix, or PayPal).

  • All donations are non-refundable, except where a duplicate or erroneous transaction is proven.

  • Receipts are issued automatically by our payment system.

  • Funds are used to support KwaYa’s charitable programs unless otherwise specified.

4. Refunds & Cancellations

This section applies to donations, event tickets, and tour/program payments.

4.1 Donations

  • Donations are final and non-refundable.

  • If you believe a donation was made in error or duplicated, email kwayaaustralia@gmail.com within 14 days with the date, amount, and payment reference so we can review.

4.2 Event tickets (concerts, fundraisers)

  • Unless stated otherwise on the event page, tickets are non-refundable, but may be transferable to another person if you email us at least 48 hours before the event.

  • If an event is cancelled by KwaYa, we will offer either a refund (less any unrecoverable third-party fees) or a credit/transfer to a future event.

  • If an event is rescheduled, your ticket remains valid; if you can’t attend the new date, you may request a refund (less unrecoverable fees) within 7 days of notice.

4.3 Tours & programs

  • An initial deposit of AUD $500 per person is strictly non-refundable, regardless of cancellation date.

  • Further payments are due by the dates stated at registration. Failure to pay may result in cancellation of your place without refund of the deposit.

  • Your cancellation (written notice to kwayaaustralia@gmail.com):

    • 60 + days before departure: refund of amounts paid minus the $500 deposit and any unrecoverable supplier costs (issued airfares, hotel/operator penalties, visa fees, insurance, bank and platform fees).

    • 31–59 days: 50 % of the tour fee refundable minus unrecoverable supplier costs.

    • 0–30 days: no refund, as most costs are committed.

  • KwaYa cancellations/major changes (safety concerns, government restrictions, minimum numbers not met):

    • We will offer a full refund of amounts received by KwaYa minus amounts already and irreversibly paid to suppliers (a breakdown will be provided), or a transfer/credit to a future tour.

  • Force majeure (events beyond our control, e.g., pandemics, natural disasters, civil unrest):

    • We will work in good faith to recover or credit as much as possible from suppliers, but refunds may be limited to what we successfully recover.

  • Travel insurance is mandatory for all tours and must cover medical, evacuation, cancellation, and disruption. Claims for losses should be directed to your insurer.

4.4 Payment disputes & chargebacks

If you believe a charge is incorrect, please email us first. Unauthorised chargebacks may result in the recovery of bank/platform fees and reasonable administrative costs.

4.5 Currency, fees & timing

  • All prices are in AUD unless stated otherwise.

  • Bank charges, exchange fees, and platform fees are your responsibility and are non-refundable.

  • Approved refunds are processed to the original payment method within 10–14 business days (times vary by bank/platform).

This policy does not exclude or limit any non-excludable rights under the Australian Consumer Law.

5. Tour and program participation

Participation in tours and programs is subject to separate Tour Terms & Conditions, Participant Waiver, and Code of Conduct issued at registration. KwaYa may modify itineraries, prices, or program details due to safety, partner, or regulatory requirements.

6. Third-party links

Our website may include links to other websites (partners, booking systems, social media). KwaYa is not responsible for the privacy, accuracy, or content of external sites.

7. Limitation of liability

While we take care to ensure information on this site is accurate and current, KwaYa makes no warranties or guarantees about completeness or reliability. KwaYa will not be liable for any direct or indirect damages, losses, or expenses arising from your use of this site or participation in our programs, to the extent permitted by law.

8. Privacy

Your privacy matters to us. See our Privacy Policy for how we collect, use, and protect your personal information.

9. Changes to these terms

KwaYa may update these Terms and Conditions from time to time. Any changes will be posted on this page with an updated “Last updated” date. Continued use of the website means you accept the revised terms.

10. Governing law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
